The Montserrat Access Declaration was a legal document that was created by Montserrat's government in response to the Islands' accession in the second half of the nineties to the United Kingdom. On 1st May 1996, a letter was sent to all residents of the Islands inviting them to begin a new life in the United Kingdom. Those who accepted this offer were automatically granted leave to live in the British Islands for two years, after which they would have to make an application for immigration status. These applications were made by a total of ninety seven people at the time.

As a result of this process, a number of different types of documentation had to be produced. The application form for an indefinite-stay application was required. It stated that no restrictions would apply to the applicant's rights to remain in the United Kingdom. It also included information about their property ownership and availability. The application required details about the applicant's previous residence to be included. This was required to prove that the applicant had not received any benefit directly or indirectly from an organization banned in the Islands. Information relating to previous convictions, including minor offenses, was another important piece of documentation required for this application.

The Montserrat Access Declaration was based on a variety of factors. In order to ensure that the applicant was not a danger to the public safety, the Islands were required to provide information about its criminal justice system. Other criteria that may have specific bearing on whether or not an individual could enter the United Kingdom were also specified, such as whether the applicant was a disabled person or was pregnant. All other relevant information was also considered in the drafting of the declaration.

At the same time, the declaration also contains information regarding the procedure that will be used in the case of any appeal that is to be lodged against the terms of the Home Information Pack. These details include the procedure for appealing and the time it should take to process the appeal. These details are again crucial to ensuring that the applicant receives fair access to the justice system in the United Kingdom. Before filling out the application form, individuals should carefully read the Montserrat Access Declaration.

The declaration does not specify the period or duration for which an individual would be exempt from certain types of British citizenship. It is possible that such an exclusion will be applied at a later time. This would apply to anyone born in the United Kingdom, but who were not ordinarily residents in that country at their birth. It is further understood that the right of an individual to an immigrant visa to remain in the United Kingdom immediately arises from the right of the applicant to be admitted to the United Kingdom as a permanent resident under the immigration laws of the United Kingdom.

Because of the importance and importance of the Montserrat Access Declaration form, applicants are advised not to lose it. An individual who wishes to obtain the information contained in the declaration should do so as soon as possible. A failure to do so could lead to a delay in the processing of their application.
